Cet accord \u00e9quilibr\u00e9 se fonde sur un partage des efforts entre locataires, bailleurs et canton.<\/h2>\n<p>Suite aux interdictions \u00e9mises par les autorit\u00e9s dans le cadre des mesures Covid-19, les locaux commerciaux abritant les activit\u00e9s concern\u00e9es sont devenus temporairement inutilisables. De nombreux locataires ont ainsi perdu pendant des semaines un outil de travail essentiel et subi un impact \u00e9conomique rendant difficile l\u2019acquittement de leurs charges fixes. C\u2019est dans ce contexte qu\u2019ont \u00e9merg\u00e9 des questions relatives \u00e0 l\u2019exigibilit\u00e9 des loyers de ces locaux donnant lieu \u00e0 diff\u00e9rents avis de droit contradictoires.<\/p>\n<h3>Une volont\u00e9 commune de trouver une solution<\/h3>\n<p>Au vu de la situation, le risque de voir appara\u00eetre de nombreux conflits sur la question est devenu r\u00e9el tant l\u2019impact pour le locataire comme pour le propri\u00e9taire est important. C\u2019est pour faire face \u00e0 ce risque et afin de pr\u00e9venir une judiciarisation syst\u00e9matique de cette question que l\u2019Union suisse des professionnels de l\u2019immobilier section Neuch\u00e2tel-Jura, section neuch\u00e2teloise de l\u2019Association suisse des locataires ainsi que la Chambre immobili\u00e8re neuch\u00e2teloise ont engag\u00e9 un dialogue visant \u00e0 trouver un accord. Dans ce cadre, elles ont sollicit\u00e9 l\u2019\u00c9tat de Neuch\u00e2tel afin qu\u2019il se joigne aux discussions et contribue \u00e0 construire une solution consensuelle.<br \/>\nBien que la marge de man\u0153uvre cantonale ne permette pas de mettre en \u0153uvre une d\u00e9cision contraignante dans le domaine du bail, l\u2019absence, \u00e0 l\u2019heure actuelle, d\u2019une solution f\u00e9d\u00e9rale a convaincu les diff\u00e9rentes parties que la mise en place de cet accord cantonal est n\u00e9cessaire et urgente. Il s\u2019agit de donner un cadre de r\u00e9f\u00e9rence clair aux locataires et bailleurs afin de privil\u00e9gier une r\u00e9solution \u00e0 l\u2019amiable. C\u2019est dans cette perspective que les partenaires ont consign\u00e9, dans un accord conclu le 6 mai 2020, une solution \u00e9quilibr\u00e9e, tenant compte des int\u00e9r\u00eats de l\u2019ensemble des parties et fond\u00e9e sur un partage des efforts entre locataires, propri\u00e9taires et collectivit\u00e9.<br \/>\nToutes les parties \u00e0 l\u2019accord se sont engag\u00e9es \u00e0 promouvoir son contenu et \u00e0 participer \u00e0 sa mise en application.<\/p>\n<h3>Principe et p\u00e9rim\u00e8tre de l\u2019accord<\/h3>\n<p>L\u2019accord porte sur des locaux commerciaux situ\u00e9s dans le canton de Neuch\u00e2tel et lou\u00e9s par des locataires dont l\u2019activit\u00e9 principale a \u00e9t\u00e9 interdite sur d\u00e9cision des autorit\u00e9s dans le cadre des mesures li\u00e9es au Covid-19. Il fixe les r\u00e8gles de paiement des loyers durant les mois au cours desquels des fermetures ont \u00e9t\u00e9 impos\u00e9es par les autorit\u00e9s et arr\u00eate les conditions de la contribution du canton, rendue possible par le montant de 2 millions de francs allou\u00e9s par le Conseil d\u2019\u00c9tat en vue de couvrir cette participation.<br \/>\nLa port\u00e9e de l\u2019accord s\u2019\u00e9tend de d\u00e9but mars \u00e0 fin juin 2020. Il repose sur deux principes :<\/p>\n<ol>\n<li>Durant la p\u00e9riode de fermeture impos\u00e9e, \u00e0 compter du 17 mars 2020 : le loyer hors charges est support\u00e9 \u00e0 raison de 25% par le locataire, 25% par l&rsquo;\u00c9tat et 50% par le propri\u00e9taire. Les loyers pris en consid\u00e9ration pour cette r\u00e9partition sont plafonn\u00e9s \u00e0 3&rsquo;000 francs pour les locataires qui ont pu reprendre leur activit\u00e9 le 27 avril 2020, et \u00e0 5&rsquo;000 francs pour ceux qui sont autoris\u00e9s \u00e0 reprendre lors des \u00e9ch\u00e9ances suivantes fix\u00e9es par le Conseil f\u00e9d\u00e9ral. Lorsque le loyer exc\u00e8de ces montants, l\u2019intervention de l\u2019\u00c9tat se base sur ces plafonds \u00e0 condition toujours que le bailleur consente \u00e0 abandonner au moins le double du montant vers\u00e9 par l\u2019\u00c9tat.<\/li>\n<li>Hors des p\u00e9riodes de fermeture impos\u00e9e : les locataires s\u2019acquittent normalement du loyer. Le bailleur reste \u00e9videmment libre de consentir \u00e0 un effort plus important.<br \/>\n\u00c0 noter que les collectivit\u00e9s publiques propri\u00e9taires n\u2019entrent pas dans le p\u00e9rim\u00e8tre de l\u2019accord mais sont appel\u00e9es \u00e0 consentir un effort qui permette au locataire de ne s\u2019acquitter au maximum que de 25 % du loyer pendant les p\u00e9riodes de fermeture.<\/li>\n<\/ol>\n<h3>Processus et outils<\/h3>\n<p>Au vu de son caract\u00e8re non contraignant, pour que l\u2019accord d\u00e9ploie concr\u00e8tement ses effets, les locataires et les bailleurs sont invit\u00e9s \u00e0 conclure une convention qui en reprend les termes. Afin de faciliter la mise en place de cette solution concert\u00e9e, une convention type sera mise \u00e0 disposition des locataires et bailleurs d\u00e8s le 12 mai 2020.<br \/>\nPar ailleurs, pour permettre un traitement aussi rapide et efficace que possible, les partenaires \u00e0 l\u2019accord se sont entendus sur un processus qui implique la participation des associations notamment dans l\u2019\u00e9tape d\u2019instruction du dossier. Celles-ci viendront \u00e9galement en soutien aux parties respectives en cas de questions.<br \/>\nEnfin, au vu de la part importante d\u2019\u00e9tablissements publics concern\u00e9s par les fermetures impos\u00e9es, les parties ont souhait\u00e9 associer GastroNeuch\u00e2tel qui a accept\u00e9 d\u2019apporter son soutien et son expertise n\u00e9cessaire dans les dossiers qui concernent des \u00e9tablissements publics.<\/p>\n<p>Par cet accord, les associations repr\u00e9sentantes de propri\u00e9taires et des locataires ainsi que l\u2019\u00c9tat offrent une voie de r\u00e9solution pragmatique permettant de tenir compte des int\u00e9r\u00eats et de la situation tant des locataires commerciaux que des propri\u00e9taires.
